Terms of Business

General

  • These are the terms upon which Rose Above (“I/we/us”) have quoted to supply their goods and services (“the works”) to the customers (“you/client”).
  • Any variation to these terms is only valid if agreed in writing by us.
  • The acceptance of any quotation should be confirmed in writing.
  • The acceptance of any quotation assumes you have read these terms of business and have understood and agree to all.
  • Quotations are valid for 30 days, work that has been accepted within those 30 days should be completed no later than 3 months from initial quote date.
  • Payment to be made on receipt of invoice, unless otherwise agreed in writing. In some cases, part payment will be requested before work begins or during projects to cover pre agreed costs.

Cancellation and Delay

  • Cancellations of arranged work will be charged at the following rates of the original value:
    • If within 7 days of the commencement of the works, 100% material costs. 50% labour costs.
    • If between 7- and 28-days’ notice, 25% labour costs
  • Any materials that are non-refundable will have to be paid in full.
  • Any maintenance contracts invoiced on a 1/12 basis, which are cancelled before the end of the period, will be subject to a final charge calculated on a pro-rata basis to account for any seasonal variances.

Access, Security, and Safety

  • I assume clear and uninterrupted access is available for the duration of the works.
  • I assume clear and clean access to all areas that are due to be worked on, including clearing grounds of, vehicles, furniture, toys, animal waste etc.
  • Free access and parking for the work vehicles and delivery of materials and plant is required. In some cases, secure storage for materials on site for the duration of the works.
  • Where parking is not available onsite, I reserve the right to pass on any associated costs and parking charges / enforcement tickets to you.
  • I assume access for HGVs for delivery is possible and that the substrate is suitable to carry vehicles and machinery.

Work Specific

Ground works

  • Please confirm prior to commencement of works, any services present on site.
  • I assume all works will be unaffected by underground or overhead services.
  • I have assumed there are no underground obstructions, services, or contaminated grounds.
  • Works quoted do not include the removal or care of notifiable invasive species whatsoever, including Japanese Knotweed and Giant Hogweed.
  • We have assumed all aggregates and soils meet current their relative specifications and comply with the British standards.

Planting

  • Planting of root ball or bare root to take place between November and March.
    • Planting outside of these months needs to be assessed prior to commencement
  • I can only plant and care for the plants with the recommended guidance to give them the best chance, I cannot guarantee the success of any plants.
  • I assume all bought plants, shrubs, trees, and seeds adhere to APAH’s biosecurity and own Plant Passports and Phytosanitary Certificates.

Tree work

  • I have assumed the client has conducted all relevant tree surveys prior to commencement of work.
  • I have assumed the client has checked for TPOs and if present, all works have been agreed by the relevant body and a copy is provided.
  • I assume the client has the correct permission to authorise pruning and/or felling of trees.
  • Tree work is not included by default to maintenance package unless specified.
  • Any stump removal is quoted for separately unless agreed prior.
  • Any roots or stumps within 300mm of hardstanding or buildings are to remain unless specified.

Maintenance

  • Maintenance packages are priced at 12 months and paid for on a 1/12 basis monthly unless stated otherwise.
  • Watering is not included in the maintenance and will be an added extra.
    • I cannot be held responsible for any local authorities enforcing watering restrictions. Consequently, absolving Rose Above of any responsibility to conduct watering.
  • Litter picking would be charged extra to the contract unless specified
    • Litter picking excludes excessive packing waste unless specified
    • Litter picking excludes fly tipping, faeces, needles, cigarette buts and any other hazardous waste
  • Plant replacements are excluded unless specified.
    • Plant replacement excludes vandalism and theft unless specified
  • Where maintenance work cannot be conducted due to unclear or unsafe access, the full rate will be charged, and those areas will be avoided.
  • I cannot take responsibility for any damage, maintenance, or repair to tools or equipment that you own and have instructed us to use.
  • I take care when undertaking general repairs in the garden, however, cannot take responsibility of further damage to anything that is brittle or in poor condition.
  • Graffiti and vandalism rectification is not included in maintenance packages unless otherwise specified.
